1. INTRODUCTION & ACCEPTANCE OF TERMS
These Terms and Conditions (“Terms”) govern access to and use of the Cloud Nine Aviation website and the provision of private charter facilitation and related services by Cloud Nine Aviation.
By accessing this website, submitting an enquiry, requesting a quotation, or engaging Cloud Nine Aviation for private charter services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
These Terms apply to all website users, enquiry submissions, clients, passengers, and authorised representatives acting on behalf of a client. Where a booking is made on behalf of passengers or third parties, the person making the booking confirms that they have authority to accept these Terms on their behalf.
If you do not agree with these Terms, you should refrain from using the website or engaging Cloud Nine Aviation’s services.
2. NATURE OF SERVICES
Cloud Nine Aviation provides private charter facilitation and related support services. Our role is to assist clients in arranging private charter flights by coordinating with authorised third-party aircraft operators and aviation service providers.
Cloud Nine Aviation does not own, operate, maintain, or control aircraft unless expressly stated in writing for a specific engagement. All charter flights are operated by independent, licensed air operators who retain full operational control over aircraft, crew, and flight execution.
Our services are enquiry-led and subject to aircraft availability, operator acceptance, regulatory permissions, and operational considerations. Any information provided on the website or during enquiries is indicative in nature and does not constitute a binding offer unless confirmed in writing.
Cloud Nine Aviation may, where appropriate, provide additional coordination or support services related to charter travel, including scheduling assistance, communication with operators, and facilitation of operational requirements, without assuming the responsibilities of an air carrier or operator.
3. ENQUIRIES & QUOTATIONS
All charter enquiries submitted to Cloud Nine Aviation are treated as requests for information and availability. Submission of an enquiry does not constitute a confirmed booking or contractual commitment.
Any quotations, estimates, or information provided by Cloud Nine Aviation are indicative and subject to change. Quotations are based on information available at the time, including aircraft availability, routing, timing, regulatory requirements, operator terms, and prevailing operational conditions.
Quotations are valid only for the period specified at the time they are issued and remain subject to confirmation by the relevant aircraft operator. Final pricing may vary due to factors such as changes in itinerary, passenger details, airport charges, fuel costs, crew duty requirements, regulatory approvals, or other operational considerations.
Cloud Nine Aviation reserves the right to amend or withdraw a quotation prior to booking confirmation where circumstances require.
Submission of an enquiry or receipt of a quotation does not create any obligation on Cloud Nine Aviation to secure or provide charter services.
4. BOOKING & CONFIRMATION
A charter booking is deemed confirmed only when Cloud Nine Aviation has received written confirmation from the client, acceptance from the relevant aircraft operator, and satisfaction of all applicable requirements, including payment terms and documentation.
Confirmation of a booking is subject to aircraft and crew availability, operator approval, and receipt of any information required for regulatory, operational, or security purposes. Cloud Nine Aviation may request additional documentation or information prior to confirmation, including passenger details, identification documents, or other materials necessary to facilitate the charter.
Until a booking is confirmed in writing, Cloud Nine Aviation does not guarantee aircraft availability, pricing, or scheduling. Any services provided prior to confirmation are undertaken on a best-efforts basis and do not constitute acceptance of a binding obligation.
Once a booking is confirmed, the charter will be governed by these Terms, the applicable operator terms, and any specific conditions communicated in writing in relation to the booking.
5. PRICING, FEES & PAYMENT TERMS
Charter pricing provided by Cloud Nine Aviation reflects the cost of aircraft charter and associated services based on the details of the requested journey. Pricing may include aircraft rental, crew costs, fuel, airport and navigation charges, handling fees, and other applicable operational expenses, as advised at the time of quotation.
All prices are subject to change prior to booking confirmation and may be adjusted to reflect changes in itinerary, passenger numbers, regulatory requirements, airport charges, fuel costs, currency fluctuations, or other factors beyond our reasonable control.
Payment terms will be communicated at the time of booking and must be complied with in order to confirm and maintain a charter booking. Failure to make payment in accordance with agreed timelines may result in suspension, cancellation, or non-performance of the charter services.
Unless otherwise stated, payments are required in full prior to the commencement of the charter. Any applicable taxes, duties, or governmental charges are the responsibility of the client unless expressly included in the quoted price.
Cloud Nine Aviation reserves the right to recover reasonable costs, charges, or losses arising from non-payment, late payment, or cancellation in accordance with applicable operator terms and communicated booking conditions.
6. PASSENGER INFORMATION & DOCUMENTATION
The client is responsible for providing accurate, complete, and timely passenger information required for the planning and execution of a charter flight.
This may include, where applicable, passenger names, contact details, passport or other government-issued identification information, visa details, and any documentation required for immigration, customs, aviation, or security purposes. The client confirms that all information provided is accurate and valid at the time of submission.
Cloud Nine Aviation relies on the information provided by the client and passengers when coordinating charter services. We are not responsible for delays, refusals of carriage, denied entry, or additional costs arising from incorrect, incomplete, or outdated passenger information or documentation.
It is the responsibility of the client and passengers to ensure compliance with all passport validity requirements, visa conditions, health requirements, and entry or transit regulations applicable to the journey.
7. REGULATORY COMPLIANCE
All charter flights arranged through Cloud Nine Aviation are subject to applicable aviation, immigration, customs, and regulatory requirements of the countries of departure, transit, and destination.
Clients and passengers are responsible for ensuring compliance with all laws, regulations, and requirements applicable to their journey, including those relating to travel documentation, customs declarations, immigration clearances, health requirements, and security procedures.
Cloud Nine Aviation supports charter planning with regulatory awareness and coordination; however, we do not provide legal or immigration advice and do not guarantee the outcome of regulatory or governmental decisions. Delays, changes, or refusals arising from regulatory or governmental authorities are outside our control.
8. AIRCRAFT, CREW & OPERATORS
All charter flights arranged through Cloud Nine Aviation are operated by independent, licensed air operators authorised to conduct commercial charter operations. These operators retain full responsibility and operational control over the aircraft, flight crew, and conduct of the flight.
Aircraft details, specifications, and images provided during the enquiry or booking process are indicative and subject to availability. In certain circumstances, it may be necessary to substitute an aircraft with a comparable alternative due to operational, technical, or regulatory considerations. Any such substitution will be made with due regard to safety, availability, and the requirements of the journey.
Flight crew are employed or contracted by the operating air carrier and are subject to the operator’s training, licensing, duty time, and operational standards. The aircraft commander has ultimate authority over the safety and operation of the flight.
Cloud Nine Aviation facilitates coordination between the client and the operating air carrier but does not assume responsibility for aircraft operation, maintenance, or flight execution.
9. Safety & Operational Considerations
Safety is a fundamental consideration in private charter aviation. All charter flights arranged through Cloud Nine Aviation are subject to operational decisions made in the interest of safety, regulatory compliance, and sound aviation practice.
Operational factors such as weather conditions, air traffic restrictions, airport limitations, crew duty and rest requirements, and technical considerations may affect flight timing, routing, or aircraft availability. Such factors may result in delays, diversions, rescheduling, or cancellation of flights.
The aircraft commander has absolute authority over the operation of the aircraft and may take any action deemed necessary to ensure the safety of passengers, crew, and the aircraft. Decisions made by the aircraft commander or operating air carrier in the interest of safety are final.
Cloud Nine Aviation shall not be liable for delays, changes, or non-performance arising from safety-related or operational decisions taken by the operating air carrier or flight crew.
10. CHANGES, DELAYS & CANCELLATIONS
Charter schedules and arrangements may be subject to change due to operational, regulatory, or external factors.
Client-initiated changes to itinerary, passenger details, timing, or routing may result in revised pricing, additional charges, or amended terms, depending on aircraft availability, operator requirements, and regulatory considerations. Any changes requested by the client are subject to confirmation and acceptance by the operating air carrier.
Delays or changes may occur due to factors such as weather conditions, air traffic restrictions, airport limitations, crew duty requirements, technical issues, or regulatory approvals. Cloud Nine Aviation will communicate material changes where reasonably practicable but shall not be responsible for delays or changes arising from circumstances beyond its control.
Cancellations are subject to the applicable cancellation terms communicated at the time of booking and the relevant operator’s policies. Cancellation charges may apply depending on the timing of the cancellation, aircraft allocation, and incurred costs.
Refunds, where applicable, will be processed in accordance with the confirmed booking terms and operator conditions, and may be subject to deductions for costs already incurred.
11. BAGGAGE & PROHIBITED ITEMS
Baggage allowances for charter flights vary depending on the aircraft type, configuration, payload limitations, and operational requirements. Clients and passengers are responsible for ensuring that baggage quantities and weights are communicated accurately at the time of booking.
Excess, oversized, or special baggage may be subject to additional charges, aircraft limitations, or alternative arrangements. Cloud Nine Aviation does not guarantee carriage of baggage beyond the limits advised or confirmed for the selected aircraft.
Passengers must comply with all applicable laws and regulations regarding prohibited, restricted, or hazardous items. The carriage of dangerous goods, restricted materials, or prohibited items is strictly subject to regulatory approval and operator policies.
Cloud Nine Aviation reserves the right, in coordination with the operating air carrier, to refuse carriage of baggage or items that do not comply with safety, security, or regulatory requirements.
12. PASSENGER CONDUCT
Passengers are expected to conduct themselves in a manner that does not compromise the safety, security, or comfort of the aircraft, crew, or other passengers.
The operating air carrier and aircraft commander reserve the right to refuse carriage, remove passengers, or take appropriate action where a passenger’s conduct is deemed unsafe, disruptive, unlawful, or otherwise inappropriate. This may include behaviour affected by alcohol, drugs, or failure to comply with crew instructions.
Cloud Nine Aviation shall not be liable for any loss, delay, costs, or consequences arising from refusal of carriage or actions taken due to passenger conduct.
13. INSURANCE
Charter flights arranged through Cloud Nine Aviation are operated by licensed third-party air carriers who are responsible for maintaining insurance coverage in accordance with applicable aviation regulations and industry standards.
Such insurance is typically maintained by the operating air carrier and may include coverage for aircraft, crew, passengers, and third-party liability, subject to the terms, conditions, and limits of the operator’s insurance policies.
Cloud Nine Aviation does not provide insurance coverage in respect of the operation of aircraft or carriage of passengers. Clients and passengers are responsible for assessing their own insurance needs and may wish to obtain additional personal, travel, medical, or cancellation insurance as appropriate.
14. LIABILITY & LIMITATION OF LIABILITY
Cloud Nine Aviation’s role is limited to facilitating and coordinating private charter services. To the fullest extent permitted by applicable law, Cloud Nine Aviation shall not be liable for any loss, damage, delay, injury, or expense arising from the operation of a charter flight, which remains the responsibility of the operating air carrier.
Cloud Nine Aviation shall not be liable for any indirect, incidental, consequential, or special losses, including loss of profit, loss of opportunity, or loss arising from delay, cancellation, diversion, or changes to a charter journey.
Nothing in these Terms excludes or limits liability to the extent such liability cannot be excluded under applicable law.
Any liability of Cloud Nine Aviation, where established, shall be limited to the fees paid directly to Cloud Nine Aviation for the specific services giving rise to the claim.
15. INDEMNITY
The client agrees to indemnify and hold harmless Cloud Nine Aviation, its directors, officers, employees, and agents from and against any claims, losses, damages, liabilities, costs, or expenses arising out of or in connection with:
• Any breach of these Terms by the client, passengers, or authorised representatives
• The provision of inaccurate, incomplete, or misleading information, including passenger details, travel documentation, or regulatory information
• Acts or omissions of passengers during the course of a charter journey
• Any use of the services in a manner contrary to applicable laws or regulations
This indemnity shall apply to the fullest extent permitted by applicable law, except to the extent caused by Cloud Nine Aviation’s wilful misconduct or gross negligence, where such limitation is not prohibited by law.
16. FORCE MAJEURE
Cloud Nine Aviation shall not be liable for any failure or delay in the performance of its obligations where such failure or delay results from events beyond its reasonable control.
Force majeure events may include, without limitation, acts of God, adverse weather conditions, natural disasters, war, terrorism, civil unrest, strikes, pandemics, governmental or regulatory actions, airport closures, airspace restrictions, technical failures, or any other circumstances beyond reasonable control.
Where a force majeure event occurs, Cloud Nine Aviation will use reasonable efforts to communicate with the client and support alternative arrangements where feasible, but shall not be responsible for losses or costs arising from such events.
17. PRIVACY & DATA PROTECTION
Cloud Nine Aviation collects, uses, and processes personal information in accordance with its Privacy Policy.
By using the website, submitting an enquiry, or engaging Cloud Nine Aviation’s services, you acknowledge and agree that personal information may be processed as described in the Privacy Policy, including for the purposes of providing charter services, regulatory compliance, and operational coordination.
The Privacy Policy forms an integral part of these Terms and should be read together with them.
18. INTELLECTUAL PROPERTY
All content displayed on the Cloud Nine Aviation website, including text, images, graphics, logos, branding, and design elements, is the property of Cloud Nine Aviation or its licensors and is protected by applicable intellectual property laws.
Website content is provided for informational purposes only. No content may be copied, reproduced, modified, distributed, or used for commercial purposes without prior written consent from Cloud Nine Aviation.
Nothing in these Terms grants any licence or right to use Cloud Nine Aviation’s intellectual property except as expressly permitted for personal, non-commercial use of the website.

Where third-party services are involved in the provision of charter services, such services are subject to the terms, conditions, and policies of the relevant third parties.
20. TERMINATION OF SERVICES
Cloud Nine Aviation reserves the right to refuse, suspend, or terminate services at any time where continuation of the service would be unlawful, unsafe, impracticable, or inconsistent with applicable regulations, operator requirements, or these Terms.
Services may also be terminated where a client fails to comply with payment terms, provides inaccurate or misleading information, breaches these Terms, or engages in conduct that may compromise safety, security, or operational integrity.
Termination of services shall not affect any rights or obligations that have accrued prior to termination, including payment obligations or liability provisions.
21. GOVERNING LAW & JURISDICTION
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services provided by Cloud Nine Aviation, shall be governed by and construed in accordance with the laws of the United Arab Emirates.
The courts of the United Arab Emirates shall have exclusive jurisdiction to settle any dispute or claim arising in connection with these Terms or the services, subject to any mandatory legal provisions that may apply.
22. SEVERABILITY
If any provision of these Terms is held to be invalid, unlawful, or unenforceable by a court or competent authority, such provision shall be deemed severed from these Terms. The remaining provisions shall continue in full force and effect.
23. AMENDMENTS TO TERMS
Cloud Nine Aviation reserves the right to amend or update these Terms and Conditions from time to time to reflect changes in legal requirements, business practices, or the manner in which services are provided.
Any amended Terms will be published on the website and will apply from the date of publication. Continued use of the website, submission of enquiries, or engagement of services after such publication constitutes acceptance of the updated Terms.
24. ENTIRE AGREEMENT
These Terms and Conditions, together with any applicable booking confirmations, operator terms, and referenced policies, constitute the entire agreement between you and Cloud Nine Aviation in relation to the use of the website and the provision of private charter facilitation services.
They supersede any prior discussions, representations, understandings, or agreements, whether written or oral, relating to the same subject matter.
